I have recently been thinking about the law as a mechanism placed to assist in the preservation of the human species or at the least to alleviate the likelihood of the species becoming extinct. It's purpose of regulating and governing relationships ;between man and man and between man and nature ensures that chaos does not run rampant. It contains the natural state of entropy in which, we has atoms, are naturally bound by. Chaos and Disorder are the default settings which make up the existence of the Human species. And i feel like the Law is a calibration to that setting in order to ensure that it does destroy everything. Such realization has given me a deeper appreciation for the law that it has led me to this idea of curating ideas on paper which outline Various Human Issues(Chaos and Disorder) and how the Law contains these issues by delineating what is Allowed and Not Allowed and bringing notice to the consequences of doing what is not allowed and explanation to why X is not allowed.

The effectiveness of the Law as a force to maintaining social order is heavily dependent on whether the people who are governed by this Law understand what is and understand it's consequence. The Law creates contracts between entities that make up society and as we know, a contract is really effective if both parties to the contract understand the rights and responsibilities.

With all that mumbo jump being said, we gather herein to dive into the Legal position of Fucking around and finding out. What does the Law say when the Issue present involves A being harassed constantly by B at a party to the point where A knocks B the fuck out and follows up with a bonus slap and kick upon B being out like a light.

The Question that we need to understand the answer to is: 1) Is A allowed to knock the fuck out of B ?- Basically, is A's actions a Crime in such a situation?

We will obtain our answer by diving into the Western Cape High Court Judgment of Sanchez v S (Appeal) (A54/26) [2026] ZAWCHC 604 (15 October 2026)

WHAT HAPPENED IN SANCHEZ: THE EVENT

Here is the Abstract of the story. X and Y who are strangers are at a party. Y starts harassing X and making unwanted physical and sexual advances persistently. X goes somewhere else away from Y. Y follows. X feeling frightened and threatened that an assault is coming, delivers a right hook to Y's jaw and knocks Y the fuck out. For good measure, X delivers a final slap and kick to the unconcious Y. X then get charged with Crime.

The Full Story is as Follows:

It all begins at a party in Bantry Bay involving the 23-year-old G. Sanchez (Referred to hereinafter a G), and a 36-year-old French-speaking complainant who was unknown to him. Now its a party so alcohol is being consumed and unfortunately someone people cannot handle their brown which tends to be a main recipe for conflict - shit popping off.

In this story the conflict began inside the venue through a series of three unprovoked, unwanted physical and sexual advances by the old French speaking man. In the first encounter, the old man stood extremely close behind G, breathing on his neck with a blank gaze; when greeted, he did not respond, prompting G to walk away. Shortly thereafter, the Frenchman approached again from behind, stepping on the back of G's shoes, pressing his body against G's back, and breathing on his neck in a sexual manner. G attempted to hold him back and had two friends intervene to ask the complainant to leave.

About 20 minutes later on the dance floor, the old man again approached G, shouting, trying to grab him, and attempting to put his mouth on G's neck. G explicitly asked to be left alone and retreated outside to the patio to remove himself from the situation.

For a reasoned unspecified in court, the Frenchman pursued Gino within three seconds of G retreating to the patio, advancing towards G with his hands in his pockets. As he closed the distance, the old man removed his hand from his pocket, made a movement toward Gino, and spoke in a foreign language. Fearing an immediate physical or sexual assault after the repeated harassment, Gino reacted instantaneously, going Mike Tyson on the old man's ass and delivering a single closed-fist punch to the complainant's jaw, knocking the Frenchman the fuck out.

The blow caused the complainant to fall straight backward, striking his head violently against the floor and losing consciousness. Approximately 10 to 12 seconds later, while the complainant lay motionless, Gino—overcome by heightened anger and frustration—crouched down, slapped the old man, and delivered a kick to his side - on some UFC shit. Realizing the complainant was unconscious, Gino and his friends placed him on his side to prevent him from swallowing his tongue before medical help arrived.

The complainant sustained severe injuries from the fall, including a fractured skull, nasal fractures, traumatic brain hemorrhages, and permanent hearing loss. Due to a severe concussion, the complainant suffered post-traumatic amnesia, losing about an hour of memory and having no recollection of who had struck him or what had transpired. Because the G's identity was unknown to the old man at the time, the frenchman's family hired a private investigator, who obtained CCTV video footage from the venue that identified G. Sanchez as the person involved.

Shit hits the fan and this investigation led directly to criminal proceedings, with the State charging Gino with crime, specifically attempted murder in the Regional Court in Cape Town.

[Now this isnt a writing for the legal practitioners. students or professional. only Its a writing meant for all because such experiences are experience that are not new under the sun. People go through such and i think its important that they understand their position when in such situations]

WAS KNOCKING-OUT THE OLD MAN A CRIME: DOES THE LAW ALLOW IT:

Now from the jump, its vital that it is understand that this is not an encouragement of violence. I am a pacifist, so the last thing i would want anyone take away from the words on the page is that violence is the solution.

In understanding whether It is Allowed or Not, we get our answer from the court's resolution of this issue. For context, G, who was charged with attempted murder was actually convicted by the Regional Magistrate court for Assault with Intent to do Grevious Bodily Harm (Assault GBH is the unlawful and intentional application of force to another person (or the threat of immediate force) with the intention of inflicting serious bodily injury on them). No criticism to the Magistrate court, but it can be inferred that they overlook the part that G was defending their dignity and physical integrity from being violated. So, the matter went on Appeal and this is where we get the answer to our question with the High Court, in its Appellate capacity providing as follows:

  1. Was G Allowed to Knock-Out The Frenchman?

Our law provides that a person is criminally liable if their action constitutes a crime. So, if you shoot someone in the head and they die, that is a crime and you will be criminally liable. However, there are exceptions to the rule, which provides for a criminal offense being Justifiably done. This is called Grounds of Justification. Say you shoot someone in the head because they are shoot at you or about to shoot at you, then that shoot to the head that killed the other person is justifiable.

Grounds of Justification for one's criminal action, excuses the criminal offense. Why, because the action at the time it was done was necessary for a number of reasons. One of those reasons is Self Defense in the event where you are in danger or threat is imminent. Now the Grounds of Justification of self defense essentially provides that you can whoop the breaks out of someone in order to protect your dignity and physical integrity from being seriously violated. For example, you are walking and someone starts fighting you, you are, by law, entitled to fight back in order to stop the attack from happening.

The Ground of justification of Self defense also extends beyond threats to your physical life or threats of a physical nature. The judgment of Gino guides us that self defense extends to defending one's dignity, bodily integrity and persistent sexual harassment. So in the event where someone is harassing in a manner that has you frightened and threatened, then you are entitled to take the appropriate measure to stop it. It important to note though that, the appropriate action you take, for self defense to be defense, has to be proportionate to the threat. Meaning, once the threat stops, then any action taken afterwards the threat actor moves beyond the proportion of the threat.

In answering our above question of whether G was allowed to Knock-out the frenchman? The answer is yes because the frenchman was attacking and threatening the dignity and physical integrity of G and G took appropriate measures to stop it. What G was not allowed to do was add a slap and a kick once the Frenchman was knocked out. For that reason, the action of slapping and kicking the unconscious body went beyond what was required to stop the threat, because the threat was already terminated by the right cross to the jaw.

The court in the Gino judgment which our analysis is based on, acquitted G of Assault GHB but found him guilty of Common Assault because of the bonus slap and kick to the already knocked frenchman. Common Assault just for context is unlawful and intentional act or omission that directly or indirectly impairs another person's bodily integrity.

Just to quickly express an opinion. I agree with the dissenting judgment from the honorable Anderssen AJ. The slap and kick were a continous act to the knock-out punch. It happened immediately after the knock-out, therefore it should have been considered as part of action taken to neutralise the threat. For example in the UFC, two fighters are protecting their lives against the attacks and threat which another poses. Usually, when A fighter knocks out B fighter, A fighter will follow-up with a barrage of attacks to the unconscious body of B. Most of the time, A fighter does not even know that B fighter is unconscious. I am no psychologist, but i can reason the additional attacks to the unconscious body as a result of instinct more than conscious action. I feel the court should have analyzed G's additional attacks in that light.

CONCLUSION: The Lived Impact of the Judgment

  1. The judgement Affirms of Rights Against Sexual Harassment in Social Spaces:

Basically outlining that individuals do not need to face severe physical violence to act in self-defence; the law protects bodily integrity, personal dignity, and the right to be free from unwanted sexual harassment

  2. The court fundamentally provided that there is No Duty to Endure Harassment:

In that People in public or social venues (such as clubs, bars, or gatherings) are not legally required to wait for an abuser to make physical contact or execute an actual assault before repelling the threat. As soon as the threat actor makes you frightened and threatened, then you do can what is necessary to stop whatever is frightening and threatening you.

  3. Importantly to note is the courts guidance in how De-escalation Strengthens Legal Standing:

Repeatedly attempting to remove oneself from a harasser provides clear evidence of a reasonable belief that an attack is imminent if the harasser persists. In order to leave no room for ambiguity, de-escalate, warn, notify and if the threat persists, then do what dou wilt.

  4. The Judgment established a line between Self Defense and Retaliation:

We have to understand that Self Defence/Private defence terminates the exact moment the threat is neutralized. Once the attacker/threat attacker is unconscious or defenceless, any continued use of force loses its legal justification.

  5. Lastly, the judgement guides those who find themselves in such situation that even though law grants wide latitude to ward off an imminent threat, we must remain aware that going beyond repelling the threat—even by seconds—carries criminal consequences, such as a conviction for common assault. ( Realistically speaking, this is devoid of the practical lived reality of fighting, so am in disagreement on what the law requires of its subject in such situation).

I hope you found it informative on what is allowed and not allowed in such situations. Understanding the rules enables one to alleviate the risk of facing unnecessary consequences. That is what this series is about, alleviating necessary risks by ensuring compliance to the boundaries that is place by the law.
